By accessing or using TalkC.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including trial users, paid subscribers, and API consumers.

2. Description of Service

TalkC.ai provides an AI-powered call assistant platform that handles inbound and outbound business calls using artificial intelligence. The Service includes call answering, routing, transcription, analytics, and integration capabilities as described on our website.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Free Trial

TalkC.ai offers a 14-day free trial with full access to Professional features. No credit card is required. At the end of the trial, you may choose a paid plan or your account will be deactivated. Trial data is retained for 30 days after expiration.

5. Pricing & Payments

Paid plans are billed monthly or annually as selected. Prices are listed in USD and exclude applicable taxes. We reserve the right to change pricing with 30 days' advance notice. Refunds are handled on a case-by-case basis within 14 days of purchase.

6. Acceptable Use

You agree not to use TalkC.ai for illegal purposes, spam calling, harassment, or any activity that violates applicable telecommunications regulations. We reserve the right to suspend accounts that violate this policy without notice.

7. Intellectual Property

All content, features, and functionality of TalkC.ai are owned by TalkC.ai and protected by copyright and trademark laws. You retain ownership of your data and call content. We claim no ownership over your business communications.

8. Uptime & Service Level

We target 99.9% uptime for our core services. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by third-party providers, force majeure, or circumstances beyond our reasonable control.

9. Limitation of Liability

TalkC.ai is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TalkC.ai shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

10. Termination

Either party may terminate at any time. You may cancel your subscription through your account settings. We may terminate or suspend your account for violations of these terms. Upon termination, your data will be available for export for 30 days.

11. Governing Law

These terms are governed by the laws of Nepal. Any disputes shall be resolved through arbitration in Kathmandu, Nepal, unless otherwise required by applicable consumer protection laws.
